Mold Exclusion Bars Tenant's $200,000 Claim Against Landlord's Insurance

ST. LOUIS - Amendments to a landlord's property insurance policy that did not include a mold exclusion nonetheless incorporated the exclusion in the original policy and precluded coverage for a tenant's mold claim, a Missouri appellate court has held. Tate v. One Beacon Insurance Co., et al., No. 0822-CC01533 (Mo. Ct. App., E. Dist.).

Missouri's Eastern District Court of Appeals ruled for One Beacon Insurance Co. on Sept. 28, rejecting appellant Shelley Tate's contention that the amended policy was separate and distinct or that it created an ambiguity that must be resolved in her favor.
