SACRAMENTO, Calif. - Evanston Insurance Co. has sued two other carriers for contribution to the defense of their mutually insured contractor in a mold defect lawsuit. Evanston Insurance Co. v. Quanta Specialty Lines Insurance Co., No. 2:10-cv-02622-JAM-JFM (E.D. Calif.).
Evanston filed the declaratory judgment action against Quanta Specialty Lines Insurance Co. and North American Capacity Insurance Co. in the U.S. District Court for the Eastern District of Calif. on Sept. 27.
The plaintiff carrier added claims against "Does 1-100," which may have issued policies to Palomar Construction and/or Palomar Builders Inc., Evanston's insured and the defendant in the underlying …
