Expert Consultant Loses Bid for Payment From Client's Settlement Funds

HOUSTON - A Texas appellate court has rejected an environmental firm's bid for part of the settlement proceeds paid by contractors to the firm's nursing home client in a mold negligence lawsuit. Rimkus Consulting Group Inc. v. Concierge Care Nursing Centers Inc., et al., No. 01-09-01024-CV (Texas Ct. App., 1st Dist.).
The First Appellate District of Texas on Aug. 31 affirmed a trial court's denial of Rimkus Consulting Group's Motion to Intervene in creditors' garnishment action against Rimkus' former client, saying the firm had "no justiciable interest" in the court action.
