FORT WORTH, Texas - A Texas appeals court has affirmed a trial court's ruling that a Texas school district can claim immunity from a former teacher's claims regarding her allegedly mold-related medical conditions. Sheri Foster v. Denton Independent School District, Honeywell, Inc., et al., No. 2-01-139-CV (Texas Ct. App., 2nd Dist.).
In its March 28 opinion, the Second District Texas Court of Appeals also found that Honeywell, Inc., which installed the school's HVAC system, did not have a duty to prevent the mold contamination of standing water under the school building.
