Ohio Court Rejects Condo Owners' Bid to Enforce Oral 'Settlement'

CLEVELAND - An Ohio appellate court has reversed a trial court order that would have forced a condominium association and developer to buy back an allegedly defective unit, concluding that the oral "settlement" relied on by the unit owners was unenforceable. The Condominiums at Stonebridge Owners' Association, Inc., et al. v. Patton, et al., No. 94139 (Ohio Ct. App., 8th App. Dist.).
Ohio's Eighth Appellate District said in its Aug. 5 opinion that there was no evidence that individual third-party defendants agreed to settle, or that the terms were sufficiently specific to be binding.
