Chinese Vendor Prevails in Dispute Over Condition of Food Additive

MINNEAPOLIS - A federal court has awarded summary judgment to a Chinese company accused of shipping mold-contaminated containers of a food additive to a Minnesota customer, citing a lack of evidence that the dietary fiber product was, in fact, damaged. Dingxi Lonhai Diary, Ltd. v. Becwood Technology Group LLC, No. 008-CV-00762 (D. Minn.).

Ruling on a motion by defendant Dingxi Longhai Dairy Ltd., Judge David S. Doty of the U.S. District Court for the District of Minnesota said in a June 13 order that given the evidence a reasonable jury could only find for the defendant.
