Court Rejects 'Mere Possibility' that Poor Construction Caused Mold

TROY, Mich. - An appeals court said in affirming summary judgment for a mobile home manufacturer that the mere possibility that a missing vent cap blamed for water and mold damage was improperly installed during construction is an insufficient basis for causation. Brown, et ux. v. Indiana Building Systems, et al., No. 289102 (Mich. Ct. App.).
The Michigan Court of Appeals also affirmed summary judgment for a mortgage company-seller and other parties on fraud and misrepresentation claims in the June 29 unpublished opinion, agreeing that those defendants had no duty to disclose problems with the house.
