CINCINNATI - The 6th Circuit Court of Appeals has rejected air traffic controllers' challenge to federal court jurisdiction and affirmed dismissal of all but one defendant in a suit over mold contamination and chemical exposures at the Detroit Metropolitan Wayne County Airport. Bennett, et al. v. MIS Corp., et al., No. 08-2567 (6th Cir.).
However, the appellate panel's June 4 opinion reversed the lower court's dismissal of claims against a mold remediation firm whose use of cleaning products allegedly sickened eight individuals in the airport control tower.
