Texas High Court Finds Coverage for Personal Property But Not House

AUSTIN, Texas - The Texas Supreme Court has ruled that the state's standard homeowner's policy provides coverage for personal property damaged by mold from a plumbing leak, despite a mold exclusion, but does not cover any damage to the dwelling. State Farm Lloyds, et al. v. Page, No. 08-0799 (Texas Sup. Ct.).
The high court's June 11 decision reversed an intermediate court's holding for State Farm Lloyds's on the scope of the mold exclusion as applied to damage from plumbing leaks.
