FRANKFORT, Ky. - Kentucky's Court of Appeals has denied an appeal by homebuyers who contended that they should have been allowed to pursue fraud and other claims against the individual owners of the company that constructed their mold-contaminated home. Tabler, et ux. v. Wolhoy, et ux., No. 2008-CA-001913-MR (Ky. Ct. App.).

In a May 21 unpublished opinion affirming the trial court's decision to dismiss individual defendants, the Court of Appeals said that the claims brought by the homebuyers against individual defendants were based on contractual duties owed by the construction firm.
