Santa Ana, Calif. - A teacher who lost an earlier discrimination case over alleged workplace mold failed to persuade an appellate court to overturn a decision denying back pay for time out of the classroom. Byrd v. Santa Ana Unified School District, No. G041297 (Calif. Ct. App., 4th Dist.).
California's Fourth Appellate District ruled on April 12 that while Denise Byrd's claim for back pay and benefits fell within a wage exemption under the Government Claims Act, she was nevertheless required to file an administrative claim under another provision of the act.
