GRETNA, La. - A Louisiana appellate court has reinstated a tenant's mold injury lawsuit after determining that the defendant landlord failed to properly admit evidence of a release in bankruptcy. Wilson, et al. v. Beechgrove Redevelopment LLC, et al., No. 09-CA-1080 (La. Ct. App., 5th Cir.).

The Louisiana Fifth Circuit Court of Appeal vacated a lower court's dismissal on res judicata grounds on April 27 and remanded for further proceedings on the claims by Loris Wilson.

Wilson alleged in a 2003 complaint that she and other family members were injured by exposure to mold while living at an apartment complex …
