Court Denies Contractor's Bid to Dismiss Vendor's Cross-Claim

SAN DIEGO - California's Court of Appeal has affirmed a verdict apportioning liability for moisture and mold damage at a hotel among the hotel itself, its general contractor and an air conditioner supplier. Hardage Hotels X LLC v. First Co., No. D05390 (Calif. Ct. App., 4th Dist., Div. 1).
The Fourth District Court of Appeal also affirmed a trial court order denying a motion by the general contractor to dismiss the supplier's cross-complaint, saying an agreement by the two parties to settle the contractor's direct claims did not encompass the cross-claim.
