Court Dismisses Misrepresentation Claim Against Trump Firm

NEW YORK - A New York appellate panel has dismissed negligent misrepresentation and bad faith claims brought against the Trump Organization and another defendant by a commercial tenant who alleges water and mold damage. Bostany v. Trump Org. LLC, No. 2010 NY Slip Op 04029 [602627/2008] (N.Y. Sup. Ct., App. Div., 1st Dept.).

The New York Supreme Court Appellate Division, First Department on May 11 dismissed three counts from the tenant's complaint, but otherwise affirmed a trial court decision denying dismissal of the case (See HarrisMartin's Columns: Mold, July 2009).
