MINEOLA, N.Y. - A New York appellate court has reversed a trial court's denial of summary judgment for a housing contractor's insurer, saying the contractor offered no evidence to counter the carrier's reliance on a work-product exclusion. Nash, et al. v. Baumblit Construction Corp., et al., No. 2009-02645 (N.Y. App. Div., 2nd Dept.).

The Appellate Division, Second Department, also affirmed summary judgment for the homeowners on their claim against Baumblit construction Corp. and assessed appeal costs for both actions against the contractor in its April 27 opinion.
