Homeowners' Association Prevails In Case of Mold-Contaminated Condominium

LOS ANGELES - On March 13, a California jury determined that the West Del Amo Pacific Condominium Association was not liable for mold-related personal injuries and other damages previously alleged by the condo's owners. George Allison and Lurley Winton v. West Del Amo Pacific Condominium Association, et al., No. YC040331 (Calif. Super., Los Angeles Cty.).

The jury found that the homeowners' association was not liable for the plaintiffs' claims of negligence, intentional infliction of emotional distress and breach of contract. The court took the arguments on the plaintiffs' declaratory relief claim under advisement and is expected to rule on it …
