NEW YORK - A New York state judge has dismissed condominium owners' injury claims against a contractor as untimely, but declined to dismiss property damage and loss-of-use counts stemming from repairs made in 2001 by neighbor Sean Connery and his family. Sultan v. Connery, et al., No. 102573/2008 (N.Y. Sup. Ct., N.Y. Cty.).
New York County Supreme Court Justice Marcy S. Friedman also ruled on March 26 that because the complaint filed by plaintiffs in January 2009 sought significantly more in damages ($15 million) than a summons with notice filed 11 months earlier, they will be limited to the earlier …
