NEW YORK - A New York court has ended a temporary restraining order that allowed a condominium owner to deposit maintenance charges into an escrow account pending resolution of her mold claims. Schottenstein v. Windsor TOV, LLC, No. 600661/2007 (N.Y. Sup. Ct., N.Y. Cty.).
New York County Supreme Court Justice Emily J. Goodman dissolved the TRO in a March 8 order denying a preliminary injunction to owner Sarah Schottenstein for failure to demonstrate a likelihood of success on her claims against developer Windsor Tov LLC and management defendants.
