RIVERHEAD, N.Y. - Homebuyers alleging that sellers concealed water and mold problems have raised sufficient questions of fact to preclude summary judgment sought by the defendant sellers, a New York judge has ruled. Giampetruzzi, et ux. v. Corcoran, et ux., No. 10909/2009 (N.Y. Sup. Ct., Nassau Cty.).

Nassau County Supreme Court Justice R. Bruce Cozzens Jr. also ruled on April 7 that the counterclaim filed by defendant sellers is for sanctions, rather than sanctions and defamation as plaintiffs asserted.
