Court Refuses to Review Order Denying Motion to Dismiss; Motion for Class Certification Taken Under Advisement

GENEVA, Ill. - A Kane County Circuit Court denied a defendant school district's petition for leave to appeal the prior denial of its motion to dismiss a case filed against it by high school students, former students, and staff who claim they are suffering from mold-related illnesses. Steinberg, et al. v. Community Unit School District 303, No. 01-CH-K-334 & 01-LK-150 (Ill. Cir. Ct., Kane Cty.).
At a Feb. 13 hearing, the court also took the plaintiffs' motion for class certification under advisement, according to plaintiffs' attorney Michael L. Childress of Childress & Zdeb, Ltd. in Chicago.
