FORT WORTH, Texas - A Tarrant County, Texas, jury reportedly reached a $58 million verdict on March 1 in favor of homeowners who sued their developer and home warranty firms over a cracked foundation and related problems in their home. Cull v. Perry Homes, et al., No. 236-184813-00 (Texas 236th Dist. Ct., Tarrant Cty.).

Robert E. and S. Jane Cull had previously seen an $800,000 arbitration award overturned by the Texas Supreme Court on an appeal by the builder, Perry Homes, which maintained that the Culls had waived arbitration by engaging in litigation that was nearing trial (See HarrisMartin's Columns: …
