Housing Authority Fails to Overturn Finding on Nuisance Law

TOLEDO, Ohio - An Ohio appellate court has declined to vacate a trial court's finding that a state nuisance law could apply to a public housing authority that manages apartment units found to be contaminated by mold. Central Residents Council v. Lucas Metropolitan Housing Authority, No. L-09-1137 (Ohio Ct. App., 6th Dist.).

Ohio's Sixth Appellate District on Feb. 12 rejected an assignment of error by Lucas Metropolitan Housing Authority, which appealed the trial court's advisory statement despite prevailing on a motion to dismiss a complaint filed by tenants to compel mold abatement.
