PHOENIX - An Arizona couple can pursue personal injury mold claims against their home's general contractor but a trial court properly dismissed contract and warranty claims, an Arizona appellate court has ruled. Light, et ux. v. BSM & Associates Inc., No. 1CA-CV 09-0074 (Ariz. Ct. App., Div. 1).
The Arizona Court of Appeals, Division One, ruled in an unpublished opinion on Jan. 28 that the injury claims made by Wayne B. and Judith L. Light in an amended complaint was not barred by the economic loss doctrine.
