Court Affirms $303,814 Judgment Against Home Sellers

TROY, Mich. - The Michigan Court of Appeals has affirmed a final judgment of $303,814 in favor of homebuyers who alleged that sellers concealed the presence of mold that sickened plaintiffs and required extensive remediation. Elliott v. Therrien, No. 288235 (Mich. Ct. App.).

The court issued an unpublished opinion on Jan. 26 in favor of Bill G. and Marie L. Elliott, affirming jurors' findings against defendants Daniel L. Therrien and Mary Ann Therrien.

The Elliotts sued the Therriens for fraudulent concealment, fraudulent misrepresentation and innocent misrepresentation, alleging that they knew about mold problems before selling their house to the Elliotts.
