N.C. Court Holds That Mold Excluded by 'Anti-Concurrent Causation' Clause

RALEIGH, N.C. - An "anti-concurrent causation clause" in a builder's risk insurance policy barred coverage for mold caused by vandalism despite the fact that the vandalism itself was covered, North Carolina's Court of Appeals has ruled. Builders Mutual Ins. Co. v. Glascarr Properties Inc., No. COA09-486 (N.C. Ct. App.).

In a published opinion issued on Feb. 2, the court distinguished case law relied on by Glascarr Properties Inc., in which coverage was ordered if caused in part by a covered cause of loss, saying the policies in those cases did not contain the anti-concurrent causation clause included in the policy …
