PHILADELPHIA - The 3rd Circuit Court of Appeals has affirmed judgment for school officials accused of retaliating against a teacher who complained of mold hazards by denying her a permanent classroom at a new building and assigning her to teach unfamiliar courses. Smith v. Central Dauphin School District, et al., No. 07-3822 (3rd Cir.).
A three-judge panel issued an unpublished opinion on Dec. 11 in which it called the judgment by the U.S. District Court for the Middle District of Pennsylvania "in all respects sound."
