Contractor Absolved of Fault Loses Bid for Sanctions

TROY, Mich. - The Michigan Court of Appeals has rejected a building contractor's bid for sanctions against condominium owners who included the contractor in a lawsuit over mold and water damage, rejecting the contractor's assertion that the claims, although unsuccessful, were frivolous. L. Todd Reed, et al. v. Shurlow, et al., Nos. 288201 and 288202 (Mich. Ct. App.).
In an unpublished per curiam opinion on Dec. 15, the court affirmed the decision of the Mason Circuit Court in favor of David and Sheri Seaman and against William Surlow and his construction firm, which built the Seamans' condominium.
