Court Orders Hearing in Dispute Over Additional Living Expenses

MINEOLA, N.Y. - A New York trial court has denied summary judgment sought by a home insurer that disputes mold damage claimed by the homeowner and instead ordered the insurer to continue paying alternative living expenses for the plaintiff pending a hearing. Bacquie v. State Farm Insurance Co., No. 22881/2009 (N.Y. Sup., Nassau Cty.).

Nassau County (N.Y.) Supreme Court Justice Edward McCarty signed an order on Nov. 17 continuing a temporary restraining order issued on Nov. 10 on a motion by plaintiff Ena Bacquie.

Bacquie sued State Farm for coverage of alleged mold damage that has made her home uninhabitable. …
