MINEOLA, N.Y. - A New York judge has denied an appeal by a state worker who claimed he was wrongly terminated by the New York State Department of Taxation for absences resulting from workplace mold exposure. Nadolecki v. State of New York Industrial Board of Appeals, No. 14138/20009 (N.Y. Sup. Ct., Nassau Cty.).
Nassau County Supreme Court Justice Anthony L. Parga said in a Nov. 23 decision that probationary employee Matthew Nadolecki failed to show that his termination was either arbitrary or unlawful.
