TROY, Mich. - Michigan's Court of Appeals has affirmed a trial court decision affirming an original arbitration award in which homeowners received significantly less than they sought for alleged construction defects. Mosher, Dolan, Cataldo & Kelly Inc. v. Feinbloom, et ux., No. 285445 (Mich. Ct. App.).
The Michigan Court of Appeals said in an unpublished opinion on Oct. 27 that a trial court did not err in vacating a second arbitration award that added $179,337.67 in consequential damages to an original net award of $48,453.57.
