Court Says Settlement Doesn't Apply to Non-Mold Defect Claims

ST. PAUL, Minn. - Minnesota's Court of Appeals has ruled that an agreement reached between condominium association members and their condominium developer applied only to mold claims, and association members are free to pursue other defect claims through litigation. Calhoun Place Condominium Association v. Turnstone Calhoun LLC, et al., No. A09-387 (Minn. Ct. App.).

The Nov. 3 opinion by the Minnesota Court of Appeals reversed that part of a lower court decision awarding summary judgment to the developer.
