Court Allows Discovery of Tax Returns on Plaintiff's Mental Anguish Claim

NEW YORK - A former tenant who is alleging mold injuries put her financial status at issue by claiming mental anguish from an inability to afford temporary alternative living expenses for a visit to a dying friend and must produce tax returns sought by the defendant landlord, a New York court has ruled. Genson v. Sixty Sutton Corp., No. 109105/2006 (N.Y. Sup. Ct.).
That decision was one of several discovery rulings made by New York Supreme Court Justice Michael D. Stallman on Oct. 20 in a lawsuit brought by Jill Genson against Sixty Sutton Corp.
