Appeals Court Finds No Basis for Property Damage Award to Tenant

NEW YORK - A New York appellate court has vacated a $3,467 property damage award to an apartment tenant, saying the tenant offered no proof of damage to support the claim. Apolon v. Jeanmary, et al., No. 1556/2008 (N.Y. Sup. Ct., App. Term, 2nd Dept.).

Acting on an appeal from landlord Jean-Michel Apolon, the Supreme Court Appellate Term, Second Department, on Oct. 6 reversed the New York Civil Court's ruling in favor of former tenant Chantale Jeanmary.

Apolon brought this lawsuit in small claims court to recover four months rent from Jeanmary. She filed a counterclaim in which she alleged …
