NEW YORK - A mold remediator's collection action against the manager of a condominium building must fail because there was no contract between the two despite allegations that the manager agreed in an email to "handle it," a New York trial judge has ruled. Emteque Corp. v. Magnum Real Estate Group, et al., No. 601292/2009 (N.Y. Sup. Ct., N.Y. Cty.).
Justice Michael D. Stallman of the New York County Supreme Court said in his Sept. 30 order that Emteque's claims fail whether they are brought as contract or unjust enrichment claims.
