D.C. Court Affirms Judgment for Attorneys in Malpractice Case

WASHINGTON, D.C. - A federal appellate panel has affirmed a judgment for attorneys accused of malpractice by their clients, agreeing with the trial court that expert mold testimony offered by the former clients was inadmissible. Young, et al. v. Burton, et al., No. 08-7113 (D.C. Cir. Ct. App.).

The U.S. Court for the District of Columbia said in its per curiam Oct. 14 opinion that the plaintiffs-appellants failed to show that the trial court erred in concluding that the proffered testimony of mold expert Dr. Ritchie Shoemaker was "speculation" that would not meet the admissibility requirements of Daubert v.
