Va. Supreme Court Refuses to Hear Appeal of $1.4 Million Judgment

RICHMOND, Va. - The Virginia Supreme Court has refused The Drees Co.'s petition for appeal of a $1.4 million judgment that was awarded in March to a couple who claimed that construction defects led to debilitating mold-related injuries. Meng v. The Drees Co., No. 091484 (Va. Sup. Ct.).

The court noted in its docket that the petition was refused on Oct. 23.

In December 2008, a Virginia state court jury awarded $4.75 million for what the Mengs claimed were debilitating mold-related illnesses caused by construction defects in a $900,000 home built by Drees (See HarrisMartin's Columns: Mold, Jan. 2009).
