Fla. Court Accepts Testimony by Shoemaker after Frye Hearing

NAPLES, Fla. - A Florida court has rejected a defense challenge and said it would allow trial testimony on causation by Maryland physician and frequent mold expert Ritchie Shoemaker, M.D., according to sources. Mathieu, et al. v. Assad Corace Construction Inc., et al., No. 2007-CA-439 (Fla. Cir. Ct., Collier Cty.).
The ruling by Judge Cynthia A. Pivacek came Oct. 5 during a Frye hearing on admissibility of experts in a personal injury and property damage case brought by the owners of a mold-contaminated home in Naples.
Trial in the case is scheduled for April.
