NEW ORLEANS - A federal judge has denied an insurer's motion for involuntary dismissal over a plaintiff's alleged failure to comply with a discovery order, adopting a magistrate's recommendation that the sanction sought is not justified. Montegut Properties LLC v. Lloyds of London, et al., No. 07-3134 (E.D. La.).
The recommendation to deny the motion by Liberty Corporate Capital Ltd. by Magistrate Judge Karen Roby was adopted by Judge Helen G. Berrigan on Sept. 30 of the U.S. District Court for the Eastern District of Louisiana on Sept. 30.
