TROY, Mich. - A Michigan appellate panel has affirmed a ruling in favor of an insurer that relied on a mold exclusion in denying a defense and indemnification to a home contractor. Hometowne Building Co. LLC, et al. v. Amerisure Mutual Insurance Co., No. 287336 (Mich. Ct. App.).
The Court of Appeals held in an unpublished opinion on Oct. 13 that an exclusion for "Fungi or Bacteria" in a series of commercial general liability policies written for Hometowne Building Co. precluded coverage for claims made against Hometowne in a construction defect lawsuit.
