Court Pares Complaint to Contract and Fraud Allegations

NEW YORK - A New York judge has dismissed eight of 13 causes of action raised by condominium owners over alleged defects in their building, but said they can pursue contract and fraud claims against the developers. Board of Managers of Woodpoint Plaza Condominium, et al. v. Woodpoint Plaza LLC, et al., No. 12579/2006 (N.Y. Sup. Ct., Kings Cty.).
But while the Kings County (New York) Supreme Court's Aug. 10 order left contract and warranty claims against the developers, the court dismissed all claims against the project's architect.
