ST. PAUL, Minn. - Minnesota's Court of Appeals has affirmed summary judgment for home remodelers blamed for water and mold damage and has also affirmed sanctions against the plaintiff homeowner and his counsel for affidavits the trial court found to be problematic. Buscher v. Montage Development Inc., et al., Nos. A08-1803 and A08-2036 (Minn. Ct. App.).
The Court of Appeals noted in its Aug. 4 opinion that the written report at issue in the lower court's sanctions order was the basis for a finding that Bradley J. Buscher's claims against the contractors were untimely.
