Amerisure Sues to Avoid Covering Claims Against Masonry Firm

MOBILE, Ala. - Amerisure Insurance Co. has asked a federal court to declare that it need not defend or indemnify a masonry contractor sued over water intrusion in an office building constructed for a newspaper publisher in Mobile, Ala. Amerisure Insurance Co. v. Structural Masonry Inc., et al., No. 09-432 (S.D. Ala.).

The carrier filed its declaratory judgment action in the U.S. District Court for the Southern District of Alabama on July 16 against its insured, Structural Masonry Inc., and the Mobile Press Register and the Austin Co., which are pursuing claims against SMI in Alabama state court.
