5th Circuit Rules Against Unlicensed Mold Remediator

NEW ORLEANS - The 5th Circuit has affirmed a lower court order preventing an unlicensed mold remediator from recovering anything more than the actual cost of materials and labor for emergency work undertaken after Hurricane Katrina. Tradewinds Environmental Restoration Inc. v. St. Tammany Park LLC, et al., No. 08-30729 (5th Cir.).

The Circuit Court panel also said in its Aug. 4 opinion that Tradewinds Environmental Restoration Inc. could not augment the record by submitting evidence for the first time on appeal of licenses from states other than Louisiana.
