Mich. High Court's Discovery Rule Decision Ends Chrysler Worker's Case




OAKLAND, Mich. - The Michigan Supreme Court's decision to eliminate the discovery rule unless specifically allowed by the legislature mandates summary judgment for a building owner sued over workplace exposure to mold, an appellate court has concluded. Colaianni v. Stuart Frankel Development Corp., et al., No. 282587 (Mich. Ct. App.).

The Michigan Court of Appeals said in an unpublished June 18 opinion that the Supreme Court's holding in Trentadue v. Gorton (479 Mich 378; 738 NW2d 664 [2007]) precluded Connie Colaianni's negligence claim against a building owner and manager.
