GEORGETOWN, Del. - Condominium owners who allege that a flood in their unit was caused, in part, by condominium association negligence can pursue claims against the association and its president, a Delaware judge decided on June 2. Freibott v. Miller, et al., No. S08C-11-025-RFS (Del. Super. Ct., Sussex Cty.).
Delaware Superior Court Judge Richard F. Stokes denied motions to dismiss negligence causes of action against the Indian Harbor Villas Condominium Association and Randall A. Snowling, finding that recovery is possible under the facts alleged.
