Pa. Appellate Court Vacates Defense Verdict, Enforces Settlement

PHILADELPHIA - A Pennsylvania appellate court has vacated a defense verdict for a roofing company and ordered a trial court to enforce the terms of an oral agreement that appeared to be reached before jurors began deliberations. Mastroni-Mucker, et al. v. Allstate Insurance Co., et al., No. 3176 EDA 2007 (Pa. Super. Ct.).

The Superior Court ruled on May 29 that an oral agreement between plaintiff homeowners and the roofing company was enforceable even though lawyers were still preparing a general release when jurors announced a quick verdict and defendants withdrew their $60,000 offer.
