CHARLESTON, S.C. - The owners of a Sheraton Hotel and its excess insurer filed competing motions for summary judgment in a dispute over the applicability of a standard pollution exclusion to claims arising from an outbreak of Legionnaires Disease in 2005. Union Insurance Co. v. Soleil Group Inc., et al., No. 2:07-CV-3995-PMD (D. S.C.).

Soleil Group Inc. and American Guarantee and Liability Insurance Co. filed motions on May 15 in the U.S. District Court for the District of South Carolina, which ruled on May 13 that a Fungi or Bacteria Exclusion in the hotel's primary policy does not bar coverage …
