WILMINGTON, Del. - A Delaware Superior Court judge has awarded summary judgment to General Motors on claims by a former Cadillac owner that his car was plagued by a moldy odor. Stenta v. General Motors Corp., et al., No. 05-C-03-RRC (Del. Super. Ct., New Castle Cty.).
Judge Richard R. Cooch also declined to order plaintiff Henry A. Stenta to return $41,199.60 he was paid as part of a failed settlement effort, noting that GM can't return the car it took in return because the car was no longer in its possession.
