Fraud and Contract Claims Against Architect are Dismissed

WOODBURY, N.Y. - A New York court has dismissed contract, negligence and fraud claims brought by the owners of a retirement home against the home's architect, ruling that the claims are either untimely or derivative, given the state's three-year statute of limitations for professional malpractice claims. Active Retirement Community Inc. v. Tritec/Klewin Constructors L.L.C., et al., No. 31510/2007 (N.Y. Sup. Ct., Suffolk Cty.).

The Suffolk County (N.Y.) Supreme Court also dismissed similar cross-claims brought against Cashin Associates by other defendants, as well as the non-contract claims against builders Tritec/Klewin Constructors LLC and Tritec Building Company Inc.
