TROY, Mich. - A Michigan appellate court has declined to overturn a trial court ruling and order sanctions against a mold plaintiff for bringing claims against an electrician that were later dismissed. Koza v. Patriot Homes, et al., No. 282347 (Mich. Ct. App.).
Michigan's Court of Appeals said in its April 28 unpublished order that the trial court's decision that the claim was not frivolous was not clearly erroneous.
Gregory A. Finkbeiner (d/b/a Unique Electric) sought sanctions after the Livingston Circuit Court dismissed claims against Finkbeiner that were asserted by William and Sara Koza in an amended complaint.
